I engaged in a cell c data contract with nashua mobile on the 25/08/2013. I received my device and sim on the 27/08/2013. I was disappointed to discover that the network connection was very poor and almost non existent at my home. In my opinion it is pointless to pay for a device that will not perform is primary function.
I took the device back to the store on the 30/08/2013 and requested that either the network connection be improved or the contract cancelled as it is still within the cooling off period as stipulated by the CPA. I have now received communication from nashua mobile requesting me to pay R6440.
I do not believe this is fair practice for the following :
A) I did not receive the service I was promised.
B) it is my right as a consumer to cancel within 7 days.
C) the cancellation fee is unreasonable.
D) the correspondence I have received from the person handling my query is unacceptable
