Upgrade for cell numbe

I took out a Cell phone contract in 2009 and was sold under false pretenses and had it sorted out eventually and now I have gone to Virgin Eastgate as I was due foe an upgrade according to my records. I was informed that I am only due to upgrade next year July. I was also told that I did upgrade and was given a Samsung phone in 2012.
We have never taken a upgrade on this contract I have only received 1 phone when the contract was taken out. I would like a explanation and who did sign for the phone with the last upgrade.
