I have to pay for a phone, i don't have yet

Upgrade on contract> new phone battery life lasts only 2hrs after charging whole night. phone 10 days old, book it in for repairs (possible replacement).after 2 weeks phone comes back, refurbished phone, with scratches on it, the front cover is loose, no software on the phone, and the speaker cover not even there. we took it back the next day and it got booked in again. today it's approx. 6 weeks and still no feedback, the bucket is being passed now, they are waiting for response from head office, I've been there just now, 26/8/2013 at 11:00am and still no proper feed back. they want to sent me another refurbished phone!!!
I don't want someone else's phone which they patched up, I want a new phone out of the box! that's what I'm paying for! I already had to pay first instalment end of july and have to pay again end of August and I still don't have my new phone! I have to use my husbands old phone now! they don't answer they're office phones, I was sitting in the store, and phoned them while there was no other customers, and they still don't answer it! please help me, I just want a new phone, which i'm already paying for, but don't have.
