ADSL Speed Slow

Since November 2012 I have been complaining about slow ADSL connection speeds only to be told it is a exchange overload problem.
In addition every Tuesday morning I have to phone 10210 to re-create my port as I then have close to no speed on my connection.
Today the call center referred me to the SLA (Service Level Agreement) which effectively says that Telkom is not in breach of the conditions as long as the speed is 10% or more of what I am paying for!
Surely this can't be legal in terms of the CPA. If I had to buy a vehicle only delivering 10% of its power it wont be seen as acceptable!
