SHOCKING SERVICE AND NO DELIVERY OF GOODS

Last year I decided to take up a contract phone. My previous service provider (Vodacom) was excellent and I had no problems with them. However, I found what I thought was a reasonable deal for a Blackberry Torch 9810 and decided to change and undertake the contract at an Mtn service shop at Featherbrooke village in the Ruimsig area (hereafter referred to as "the shop"). After approximately 7 months, the phone became inoperable. I took my phone to the Mtn service shop at Featherbrooke for repairs on 3 December 2012. I was never contacted in the 14 day repair period. I returned to the shop in person to find out what was happening. The frontdesk assistant (Gertrude) then informed me that my phone had been from inside the shop and a claim would have to be lodged. I was then never contacted again so I returned to the shop in person on two more occasions later to be informed that I had three options; take R3500 cash, get a sub-standard phone (9360) or get a display phone (9810). I am absolutely shocked and fuming that I have been paying for a phone I have not had for almost two months now and still do not have and my only options are undervalued items. Surely this is against FICA?
