BLACKBERRY SWITCHING OFF ALL THE TIME

I took out a contract with Chatz Broadacres have been with Vodacom 12 years. Received a 9320 Blackberry which after 1 and a half month started switching itself off. Took it into Vodacom Fourways they said it was repaired. Still switched off and I made notes of every time it did it with dates and times. about 15 in the last 2 months. Took it back to Fourways who said they would have to send the phone to head office and it would take 21 days. Had no replacement phone to give me with E mail facility which I need and so I had to use my husbands phone, They now tell me they cant find anything wrong with the phone and so Fourways are now putting a new battery and if it still gives problems I have to bring it back again. Where is the CPA ruling that says I have the right to demand a new phone after it has now been in twice for repairs. I want my contract cancelled and I will go to another service provider with this rotten service I have received.
