Faliure to replace a faulty new cellphone

A cellphone was purchased from mtn, samsung s3.A month into the contract the phone had problems with its battery life, screen display flickering as well as camera going off on taking pictures. I had taken the phone in the store on the same month and he consultant did recommend i send it back and receive another phone with the obf warranty. I explained o him i am in the corporate field and very reliant on my phone daily with work and business. He explained that i have 6 months to do his and i told him that would be fine during my week of leave i return the headset. I have just returned the phone and get a reply that it will not be replaced and repaired instead due to the fine print which i was not aware off.the phone had a scratch which samsung refused to approve there warranty and was sent back to mtn a week later for repairs.i have had a similar problem with mtn in 2000 with a different handset and returned the handset to them and cancelled my contract and did not pay for it as the phone was booked in probably 10times for recurring issues.i do not want the same issue in 2013 and hence would just like to have a new handset due to the many problems with the phone and not for a phone to re
