Refurbished Blackberry 9900

I purchased a blackberry 9900 on contract, 2 months into the contract the headset's speaker became faulty and it made it difficult to hear the person on the line speaking to you.
I had it returned as I understand defects do happen, this is where it all went wrong.
The turn over time was 4 weeks (one month) to get my phone back. Then I was told it was replaced with a brand new phone. I picked the device up the day I went on leave not noticing it had been replaced with a second hand refurbished phone. The touch pad was completely unusable in sunlight, signal was intermittent it did not register my brand new memory card and every time I had to reset the phone to solve the signal issue all the settings were lost. Now again the device has been sent in for repairs with an expected turn over time of 3 weeks. Almost 2 months I did not have a phone yet I am still expected to pay the contract fees. Then I was told by the representative that a refurbished phone is not secondhand? I'm sorry the parts that were not replaced when it was refurbished makes it second hand (USED) And I am paying for a new phone not a used one with more issues than the new one I had returned.
