Problem in device and contract

Hi,

I delivered my document for contract at 16/May/2013 and I received my cellphone at 24/May/2013, my simcard is suspend and not working and at 27/May/2013 is activated. I test my cellphone (sony xperia Z) and after 1 week I returned it to branch because the battery is finish fast and the cellphone is very warm when I used that.
At 04/June/2013 until know my cellphone in MTN and the responsible person at Branch not help me.
I need the my cellphone and the MTN take the money from my account but at I am not use my cellphone.
If MTN can not give me a phone to me I want cancel my contract without pay any cost because this problem from MTN.
The people in branch is not answer me in good and totally said WE CAN NOT DO ANYTHING WAIT, I wait now 3 week but again my problem not solved.
It is very bad for big company that do this for money with costumer.
I want cancel my cellphone and claim MTN about services and behaviou
