Network Problem Phone

My Sister bought me a Blackberry phone at Sport Scene on Friday 5 July 2013. At first it looked like it had a network problem but Refiloe managed to fix it and told my sister that it happens with new phones on MTN network. The whole weekend the phone gave me problems, dropping calls while talking or going straight to voicemail when people called.
8 July 2013 i took it back to the store and Explained my problem and i was told to take it to MTN, which i did. when i got to MTN i was told that Sport Scene has to give me a new phone because its within 7 days. i went back to Sportscene, then i was told that MTN has to confirm in writting that i must get a new phone. I went back to Sportscene but they refused. i asked to speak to the manager they ignored my request until we decided that i take the phone home and see if ill get the same network problem. same problem persisted and i took the phone back to sportscene on The 9 July 20013. they still didnt give me a new phone. They tested the phone and called it and it went straight to Voicemail but the network bar was full. so i left the phone there. I was told its gone for repairs so my question, how do they take a new phone for repairs?
