We recently purchased the abovementioned property from Remax. We took occupation on the 1st March 2013 and have found defects of more than R50 000
We requested the declaration from the state agent Mr Dirk van Niekerk and were advised that they did not bother to do one and as we got the house cheaper than what was being asked and that we should accept all of the above. We have had no help or co-operation from the attorneys (Tate, Nolan and Knight Inc.) whom the seller advises were put forward by the agents. We are advised that the seller is not able to afford to make good the defects that should have been declared. He has owned the house for 17 years and not only will be making a profit but was very aware of the serious defects in particular the water coming up through the floor in the house, the pool being completely unusable and the gates being gutted and broken.
The deceleration is required by law to protect the consumer from unscrupulous sales people and sellers. There is no regard being shown to our plight - the result of which has landed me in hospital for 10 days with what may be very serious consequences - and which is draining our finances at an alarming rate.
