I moved into a cottage on private property at 266 State Road in Midrand on 31st August 2012. Miss Iris Baker (landlord) promised to repair everything during the first 6 months and made notes of everything faulty on the inventory list. A couple of months later after continued requests to tend to the leaking roof, fix the outside lights and stove I was told pointedly that an inventory list is "NOT a to fix list". Then I suffered a breakin and a few things were and the burglar had gained entrance by smashing the glass sliding door - true to her colors Miss Baker is holding me accountable for her insurance excess as if I broke in myself. I had a lawyer instruct her in writing that by law it is her responsiblity and that she must tend to all the faulty things on the inventory list and repair the gate within 14 days of we can see it as breach of contract and move - she has sinced ignored every word in the letter and continues to hold me responsible for the insurance excess - she is abusing me as a tenant. Not to mention her sourage spilling into my yard from her drain. Question is, If i move will i be in breach of contract? What are my rights? Any advise? WHAT CAN I DO???
