Deliberate misstated facts causing loss

A while ago i was contacted by Johlene, asking when my car would be available for pickup. We explained to her that my car had been written off by Outsurance due to hail damage, and that picking up the car wasn't an immediate option as the original registration certificate was in a deceased Estate. This meant that SMD had to wait because I could not sit without a car for weeks on end. Johlene said she would see what she could do in this regard and would try and speak to Outsurance. A few days later, Johlene phoned back and said that it is sorted, and Outsrance would pay out as soon as they got confirmation that the car was handed over to SMD. On Friday MY car was picked up and i awaited payment. Nothing came... obviously. Outsurance informed me that i still need to hand in the certificate before payment. This means that i am now stranded.

I trusted that you were acting in good faith, but obviously SMD misrepresented facts in order to get their way. I had the right to keep the car until the documentation was made available, but SMD took away this choice by deceiving me.

I am severely dissatisfied with the way you do business. You can expect to be contacted by my lawyer shortly.
