Hertz pocketing client's damage excess money

On 23 March 2012 I reported an accident in which a Hertz client caused damage to my car. In my account of the incident, I explain how the Hertz client (HC) executed an illegal manouevre while driving in the left lane of the traffic circle and attempting to leave the circle at the 3/4 exit without looking behind/beside him. As I was driving in the right hand lane, intending to go straight (the 1/2 exit), I realized what HC was about to do (blocking the 1/2 exit) I steered to the right in an attempt to avoid a collision. At that time HC realized his mistake and steered his car to the 1/2 exit of the circle. Not enough, though, to completely miss me: his right front scraped my left rear fender. The Police report supported my version of the incident. It is unclear if HC reported the incident to the Police. In breach of his contract, he only reported the incident when he returned the car. Hertz - for months - refused to respond to my broker's correspondence. In October 2012 I was informed they were not going to pay for my repair costs (R3, 400-00) because of "conflicting statements" This to me is.
