1. On or about the 24th July 2023, I signed an offer to purchase the aforementioned Mercedes Benz. The sales person was Mr Simon Mehlare at Eastrand Mercedes dealership. The offer was accepted. I paid a deposit of R1 million (R500 000.00 in cash and the balance through a trade in of a Mercedes S500). I took delivery of the vehicle on or about the 28th July 2023. However, I am yet to receive a copy of the agreement of sale.

2. On the day of delivery, the vehicle refused to start and the technician was called to fix the problem. After sometime the vehicle started. I drove the vehicle and parked it at home.

3. The following day the vehicle started but it reflected a host of warning lights from the dashboard and the windows were refusing to roll up.

4. The vehicle was collected from my home back to the dealership, where it stayed for approximately 2 days.

5. I thereafter took delivery and on the same afternoon the vehicle repeated the defects I mentioned above but this time it was worse because it also refused to start. The vehicle was again taken back to the dealership and eventually ended up at Mercedes Benz Bedfordview as advised by Mercedes Eastrand dealership.

6. The vehicle has since been at Mercedes Bedfordview from approximately 25th August 2023 up to now. I have not heard a word, either telephonically or by email from both Mercedes Bedfordview or Eastrand, notwithstanding my several enquiries.

7. The following persons at Mercedes Eastrand mall are aware of this matter:-
- Shaun Venkiah (Principal Dealership)
- Vivian Dalzell (Sales Manager)
- Simon Mehlare (Sales Executive)
- Dirk and his service Manager at (Bedfordview Mercedes)

8. All of the aforementioned persons were informed that I was no longer interested in the vehicle because of the several defects it has. All of them have conceded that the vehicle indeed had defects to an extent that Shaun and Vivian undertook to assist in replacing this vehicle with a similar and new one.

9. I am now left with no option to approach your office for assistance on an urgent basis. I need as a matter of extreme urgency, a replacement vehicle of the same nature or the refund of the total deposit and the instalments already paid.
