Our property ERF 642 Naturena transferred and registered into Ms Pretty Dube's name on or about 10 February 2011. She was already deceased during this period. Ms Pretty Dube deceased on 2008/01/20. Nedbank home loan is registered as the mortgage in favour of the property. Nedbank Home Loans has failed to conduct any security checks and client verification on Ms Pretty Dube in its endeavours while granting the bond.
Our property is currently severely vandalised and it was not vandalised when transferred and registered to Ms Pretty Dube's name. Nedbank agreed to re-register the aforesaid property back into our names at its sole expense.
We requested Nedbank to compensate our family for the vandalism of our property to place it in the condition it was prior to the property being transfered out of our name. Nedbank is unwilling to accept liability to vandalism which occured to our property. The damage is so severe that we cant afford to repair our property. To simply transfer it back in our name is not good enough.
We were and are not Nedbank mutual clients.
It is our humble understanding that a deceased person cant resurrect from the grave and apply the bond
