3rd party claim problems

I was involved in a accident and the other party's insurance is with Execuline / Hollard Insurance co ltd / Botha & Sutherland. The other party bumped into my car from behind while stuck in traffic and traveling between 0 & 7km/h as per the statement of the guy that bumped into me. Now his insurance refuses to settle my claim in full and made me a ridiculous offer. The attorneys claim that I should have given additional signs that I was going to stop "suddenly". How sudden can you stop while in traffic? I asked then to respond on my question "what about a legal following distance? " This is the response I get from their attorney: " We are under no obligation to furnish you with a reply to your question and we are more than prepared to argue this matter in court.
We are for sake of an amicable settlement prepared to state that our client did indeed keep a safe following distance but did not reasonably expected a sudden stop"
Their offer does not even cover the cost of the bumper to be replaced.
Why should I now be at the wrong end if someone bumped into me?
