Victim of crime and not getting paid back

On Friday the 30/08/2013, my account got hacked and three withdraws to the value of R4750 was taken out of my account after my bank card has been swallowed at an FNB atm, literally five minutes later the three withdraws happened at an Absa atm to the value of R4750.
Nedbank said they will investigate and let me know what happens and that it is a 50/50 chance of me getting my money back, Nedbank now refuses to pay me back as they say I am just a victim of South African crime,

Nedbank said that because a pin was used they will not pay me back, I have proof that my card got swallowed before the three withdraws went off, I reported it and stopped my card immediately and now they saying that they are not liable and I am just a victim of crime.

Why do banks have insurance then?
There are many people that this has happened to and they have all got their money back, why cant I?

When I asked for the divisons number they said they could not give it out!!.
I will not let this go
