The National Prosecuting Authority
Mismanagement of Rape case of Minor

Good Day

Hope that this finds you well. I would like to know who to address the matter with of this case been struck of the roll without the mother of the minor been called to court. The reason is that the docate is missing that does not work as it is electronic and the copy would be on the system. The whole reason for me sending this msg is to find out what is happening, this matter should have been at trial. I will be addressing this matter with the child abuse foundations, with gender based violence association as well as the Presidential hotline to assist. This is a matter that I will not let go off until justice is served.
I will use full social media sites, news papers who ever will listen and assist.

I thank you in advance for your assistance.

Regards

Brenda

Subject: Log a complaint against the SAPS Lenasia on miss handling of a Rape case on a Minor

Good Day

I not sure if this is the right platform to log this matter. I do hope that you would be able to advise.

My Cousin was sexually abused in August a case was opened at the Lenasia SAPS. I would like to firstly state all the matters at.

My Cousin is 16years old she was at her dads place in Lenasia South for the weekend. Her cousin was over he is from her dads side. The sexual assault took place at her dads place.

I got informed of this matter via her mom, we in turn went to the accused home as they stay in Lenasia. On my arrival there where a lot of police not sure who called them, but they accused dad is part of the CPF. We tried to speak to the family but was told by the SAPS to leave and go open a case. They boys mother pulled a knife for my cousin. At that point another SAPS vehicle arrived. We left to the police station to open the case. At the SAPS waited for 2 hours until I had to call the Super to get assistance as we asked at the desk and was told to wait outside as everyone case is urgent. We are talking about a minor. ( the other people that were there were for affidavit and certification).

He statement was eventually opened but she was told to go to Lenasia South as this is where the crime took place. She went with the SAPS and then was taken to the hospital. With nothing been done they left the hospital around 1am and was told to come back the next day. The accused was taken to Lenasia where his dad has friends and not to Lenasia south where he should have been taken as this was told to mom that this case is for that area. They did what was asked by the SAPS and hoped that the law would take care of this matter in the way that if should be handled. The accused was not arrested. He was in turn taken to the Lenasia SAPS by his family and was released into the mothers care. A week ago they case went to court and the mother was advised that it was going to court on the Friday which did not happen they took him to court on Thursday and informed the victims mom after. That he was released into the care of the uncle. This case should not be handled by the SAPS as this is a minor and there is a victims unit that should handle this, as I feel the SAPS is not doing their job.

Later that afternoon SAPS arrived at the house to arrest the victim’s sister, s the accused opened a case against the sister for assault and damage to his phone. I don’t understand when that would take place as the yard was full of SAPS and they would of detained her if that took place. So now they opened a counter charge and have been asking the mom to please not go through with the case, if she do they will push to have the daughter arrested.

Your advise in this regard is much appreciated.

Brenda
