Not willing to trace phone

My phone was and we were told by MTN that they can not trace the phone without a court order. How can this be true? Surely the phone can be blacklisted - so it can not work any longer? and traced? It's an iphone but we erased it via iCloud to protect personal data - so can not trace it ourselves any longe
