NEW PHONE/CANCEL CONTRACT WITHOUT ADDITIONAL FEES

I bought an iphone 5 on the 17/01/2013 and I had it for a month & few weeks. It started giving me problems, I couldn't scroll up & down so I took it to back to the store where I bought it so they could book it for a warranty assessment as I had only used it for less than 2month's. When it came back from that department it came back as a decline due to its condition, the phone had a few scratches on the corner because of the cover I bought from them. Now I'm being told that they cannot give me a new phone but can only take it in for repairs. I told them that I dont want it to be repaired as I hadn't used it for a long time I want a new one or I would like to cancel my contract with them as they have sold a second hand phone to me and I will not except that as I am the one who is gonna be paying for damaged goods because thats what it is, you cant buy something today only to find that its not gonna be working the next month because somebody did not do their job properly. You spend so much to buy a cover only to find that its gonna damage your phone & you pay so much for damaged good as well (second hand phone). I expect to get get good services from them as I am paying for it
