Cell c DECEIT over OBF iphone 5- EXCUSES

We took out two iphone 5 contracts with cell c menlyn in january. the one iphone is an OBF (the battery dies within hours). we took it back to the store within 7 days and were told that it would be replaced with a brand new handset within 21days. still no feedback over a month later we called to enquire about our phone, only to discover that the previous store manager had left and did not book our phone in; but that the problem will be seen to as soon as possible.

we received our 'new' phone at the store, but the same problem occurred with the handset, we took it back to the store 2days later. to find it is refurbished and although the previous manager was at fault we will have to settle for the phone being repaired. we discussed with the new store the manager the situation and that we should not be held liable for an employees incompetence, he reassured us that he would find a satisfactory solution. Only to now be told that apple's policy states that OBF handsets can only be replaced with refurbished handsets even though the handset was given in within 7 days. its been a frustrating battle with disappointing customer service we now want the contract cancelled and refunded.
