New cell phone not repair - now 9 month old

I have taken my wife's contract from Vodacom to 8ta. We received a new Motorola Defy from them that from day 1 could not send MMS's. Today I went back there to get another phone but they are unwilling to help me because the manager Benneth is not there. This is the 3 time the manager is not in the branch??? I will now return there tomorrow to see this manager so I can get a new phone. I just wonder if they will pay me for my time and car that would amount to - R4000.
They have tried to fix the phone in the branch 2 times. They sent a techie that could not fix it. They sent it in for repairs and still no joy. We have now driven 7 time to this branch. The level of service is pathetic. How can a company not fix a phone in 9 Month?
