Poor customer care from Vodacom

I bought a blackberry 9900 on sept 3 2012. It has been sent in for repairs @vodacom sandton on 14-3-2013 this is 6 months after the purchase. The have said they cannot repair my phone and will give me a refurbished one! I do not agree with this since the phone has never been damaged by myself but is a manufacturer fault. So I must carry on paying a premium for my phone but receive a second hand item. This appears to be day light to me. They say because it's out of the 6 month period that's what I get. Well I made a call to the customer care centre on the 14-02-2013 which was on the 5th month complaining about the very issue it went in for. The consumer council agree. Think I should get them to contact Vodacom just to show them that customer is king. I've asked vodacom to cancel my contract. They want 11000 to do so (asif I'll pay that). My ultimatum to them is give me a new phone or cancel the contract at vodacom's expense. Why must I settle for less. I look for ward to their response.
