Phone sent for repairs but nothing done

My Samsung Galaxy Note 1 (which I got in Dec 2011 on an MTN contract) has been acting up. My screen flashes, Ii lose signal and then the phone switches off. I went to the MTN walk in centre in Morningside to be told that if they take it in it will take 3 to 4 weeks to repair, however if I take it to Midrand it would be 1 day. So I took it to Midrand myself. Handed it in, told the lady at the desk that It was not a software issue, but a hardware issue. Got it back the next day with a sticker on the battery saying faulty accessory and then I was told that my phone had been repaired by upgrading the software and the OS. When I handed the phone in it was running Android ICS, when I got it back after the "upgrade" it was running Gingerbread. Please explain how that is an upgrade. I asked if I could buy a new battery, but nowhere in Gauteng stocks the Note 1 battery. This phone is less than 2 years old. This is unacceptable. How can Mtn sell the phone but not keep the accessories? My phone does nto stay on for more than 10% of the battery life. It is in effect useless. And I cant upgrade as I still have 9 months left on my contract. Please explain what I should do?
