Every fix they say physical damage

I have just upgraded to a blackberry 9230 a month and a half ago. The phone does not hold a charge the charger gets hot the phone gets hot. There is not 1 scratch not one bump the phone has still got its guard. Sunday night while charging the phone it got super hot the charge got hot as well. they screen was smudged and looked cracked. I took the to the store in west street Durban. I then received a sms giving me a job number telling me the repair will cost R578.25. I called back querying the reason why should i pay. The agent informs me that the screen is not covered under the warranty. I have had this same problem before when i asked to fix my e7 After a complaint they find out that its under Nokia's 1 year warranty (and it was fixed) Just standing outside of the store every person leaves unhappy. Please this phone was faulty and i would like it fixed. As per the CPA part H section 55 Consumer's rights to safe, good quality goods. The phone and charging heating up like this is unsafe and the phone cannot hold a charge and now the screen breaks is not good quality these phones are boxed and not tested. this phone is 1, 5months old not good service. please assist
