The basis of contract in my understanding is "consensus" between the contracting parties.
At no stage in the process you describe, was there a clear description of services offerred from your side or consensus from my side of the (non "whatsapp" services) that kulaville offer and the costs of this service If at any stage you had clearly and prominently placed a clear reference to "subscription service billing costing R7.00 per day" I would have avoided you web site like " the plague. The subtlety of the subterfuge of concealing the services you offer (other than whatsapp) and the cost of R7-00 per day, is the first basis of my complaint The second basis of my complaint, is that I have never used your services In the period of 12 December 2012 to 21 February 2013, when the deceiptfulness of the unauthorised subscription billing to my cellphone account was uncovered. So I have received no value for the Rand amounts which you have unlawfully deducted from my cellphone account. The banner advertisement of kulaville is misleading in what it leaves out and is "crafted to deceive" in omitting clear reference to a R7-00 per day cell phone subscription billing.
