New cellphone contract but faulty phone

I took out a cellphone contract on the 17/11/13, the day i took the phone home it just switch off on its own, since it was a new phone i assumed that the battery needed charging, i charged the phone.when charged i went through the phones features & it switched off a few more times.i took the phone back to cell c a few hours after purchase & the manager checked the phone & said that there is nothing wrong with it. i insisted that im not happy with a faulty phone, she then said that the phone will have to be sent to joburg for a check and it will take 7 days for this. i waited 14 days and still the phone did not come in.i went to cell c & when i asked if the phone is back the manager says that it just arrived a few minutes ago.the manager said that it went for a check and there is nothing wrong with the phone. as i took the phone out the store it switched off again, i went to the assistant manager who also checked the phone & it switched off in front of him.the manager was informed & it also switched off in front of her, she then says that it must go back to joburg for a check. i insisted that i want a new phone but she refused. she sent it back to joburg & i still dont have my phone.
