Phone not returned and double charged

I sent my Blackberry 9300 BOLD in for repairs and have sent numerous emails to find out where my phone is as I would like it back after all it is quite an expensive phone- NO RESPONSE for a year!!!
I then get my upgrade in October and pay for the handset etc in the shop in Greenstone and then receive my invoice for October and I have been charged again
