Lackberry Z10 not working

I took blackberry Z10 on the 1st of April 2013 from mtn store in century city. The phone has been giving me problems since i got the phone. I went to mtn vangate and was told i must take it back to century city where i got the phone they cant help me there. 1July 2013 i went to mtn and was told that they have to take the phone for some assessment and they will give me an answer by Friday that week. I went back only to be told that the phone have scratches so they cant exchange the phone for a new phone... the problem with the phone is that... it just switches to silent without me changing it and when it does that, i cant make or receive phone calls.. wich is really annoying. I am very upset coz the scratches on the phone have nothing to do with the software.. i mean blackberry guarantees that the phone will work and i have had problems with my blackberry Z10 and mtn service.. the phone came back Friday that week n the phone was blank with no software. I refused to take the phone as i did not hand it in like that. It took more than a week for me to get my phone n its still not fixed. I still have the same problem.. i am a very unhappy client. Mtn and blackberry.
