I would like to lodge a complaint against Vodacom for false and/or misleading advertising and refusing to deliver on what they advertised.

I am complaining about a flyer that is available at Vodacom outlets in KZN as well asbeing printed in the Daily News. It advertises the Samsung S4 on Vodacom Smart S for R399 per month for 24 months with an added 250MB of data per month for the entire 24 months. However, when I wanted to upgrade my current phone to this package, I was told that it is only valid for new contracts. This is stated nowhere on the flyer.
According to the Consumer Protection Act a company must be able to deliver on what they advertise, why does Vodacom consider itself exempt from this ruling? This has also been reported to the National Consumer Commision.
