Incorrect contract period now I can't upgrade

In December 2012, I went in to Cell C store to sign a month to month contract because there was no phone I was interested in at the time and I wanted to wait for the blackberry Q10 to see if I like it. I informed the assistants in store and even stressed to them the reason why I want month to month and they assured me I wouldn't have a problem upgrading. So when I decided what phone I want, I called Cell C to upgrade. After holding for ages I finally got through and imagine my surprise when they inform me... That I can't be upgraded because I am on a 12 month contract and I have 7 months remaining?! So on saturday, I went in store to find out what happened? They said they would investigate and sort out the issue and I should rest assured I can come in on Monday to collect my new phone, they even helped me fill out the paper work for an upgrade. On Monday I call to find out if I can come and collect my phone? I was told I elected a 12 month contract?!!! The reason they gave, I can prove is not true! So I called Cell C back and laid a complaint, she said she would escalate it and yet still I sit with no phone and no response on any progress, just me and my frustration.
