Zone Fitness
Collection fees that aren't stipulated in contract

Hi, I have been paying my membership over the counter faithfully for 3yrs... Management at Zone Fitness Fish Hoek has placed the following notice up "Attention member. As of 1 August 2013 there will be a R10 surcharge should you wish to pay your fees in advance or cash. The fee is supported by our contract and is stipulated at the back of the contract under the "further membership agreement" section and read as follows " in the event of a member failing to pay any instalment on the due date, the company reserves the right to raise the full outstanding amount in terms of this agreement inclusive of interest and collection fees" Firstly the extract does not mention that you cannot pay cash. Secondly it says it can only charge a member failing to pay on the due date. Therefore if I pay cash on the due date no where in the contract does it say I I need to pay a penalty. According to the legal aid clinic, a collection fee may not be charged unless you are registered debt collector/ attorney. One sided changing of contract/fees is grossly unfair

I would be happy if you ask Head office to instruct the branch to remove the notice and discontinue this unfair consumer practice.
