A assylum seeker was employed 2 years ago. It turns out that this person has created these documents and has not updated these documents despite repeated requests to which end we terminated his employment agreement which means the accomodation which was part of his employment agreement would be terminated. A reasonable condition in any industry. This person subsequently laid a complaint with the Ccma stating he did not understand the reasons for dismissal. The commissioner then stated very clearly that this does not constitute a fair reson for dismissal and that I have 2 choices- 1) Agree to pay him R7000 to get back to his country or take the mediation to court and lose the case because he is illegal and end up paying R24 000 to this person! Since when is documentation considered fair in labour law in favour of the guilty party?
