Unethical Service and double selling of cars

I signed an offer to purchase a car on Saturday and Mervin called to congratulate me on my new car due to finance being approved. there where a few things that needed to be sorted and Mervin had confirmed that it will be done and the original price of R159990 will remain. On saturday we did discuss a holding fee of R2000 which Mervin said was non refundable and i disagreed with cos i said if the car is not has what we agreed on then i have every right to cancel the deal and Mervin agreed and becos i signed the OTP he said he didnt want a deposit. on monday mervin then called me to say he needed to make a booking with BMW so it could go 4 a servie and quote on extended motor plan. he then called me about 3-30 to say the car went to BMW and the found a descripency with the milage and BMW is investigating it. i still told him it was fine and i would take the car just keep me updated. i asked where was the car and which BMW it was with he couldnt answer and said he will call me Tuesday. i left severla messages 4 him 2 call do date no call was returned. i sent him a e-mail confriming i would take the car and a few hours later he e-mailed me to say it is SOLD? UNETHICAL...
