Damaged brand new lounge suite/refusing refund

I purchased a brand new lounge suite from the manufacturer ie Monaco Lounge, Eikenhof, Jhb 3weeks ago. I have had a lounge suite for over 6yrs, and my kids and I were thrilled to purchase one finally with the monies i recieved from my retrenchment. This was a COD transaction. It was delivered at 8pm and sadly, by the next day i discovered the seating of one of the 2 seater was broken. There were threads hanging all over the lounge suite. Everyday i discovered something wrong: stitches open, fabric fraying, cushions noisy (cheap inner used), shades of fabric were light/dark on the seaters, and not as comfortable as we imagined it to be..He called to check wether the lounge suite was delivered. I told him it was but im dissatisfied. My landline was faulty (noisy/faint) so i couldnt hear what he was saying. The network reception is just as poor, calls keep failing on my cellphone. So i got my sister to contact him from work and he told her he will send someone to fetch. Now 3wks later the lounge suite was fetched, and he does not want to refund me, saying he will fix the faults and send it back because i used the loung suit. If he fetched it when I reported it, would have not been used. Poor, Pathetic service
