False km reading on odomete

I reported a case involving arnolds motors in klerksdorp where I bought a bmw 330 diesel in august 2011. It had 141000km on the odometer the day they delivered it to me. I drove it until it had 157000km on the odometer. 16000km more or less when it broke down. Mechanical failure on the gearbox. After some investigation from my side I found out that the kms had been turned back 60 000km. I have got all the evidence in my possession which I send through to the ombutsman in october last year. The dealership denied everything and still does and the car is still standing broken. I however pay the payment every month to absa despite the fact that I still don't have the car. Up until today I haven't received a phone call or nothing from the ombutsman. If I refuse to pay the payment to absa it affects my 'relationship' with them, but in the end it was them that financed it with the false reading and all. So now the car is still standing at the garage and its being man handled as its an automatic gearbox. So we are not even speaking of body damage but I still have to pay R2500 a month for it. Fair???
