Received broken cellph on del and no one cares

I took out a new Cell C contract with Bayport and received my phone, the Blackberry Curve 9360 on Friday, 15 March 2013. From the moment I took out the phone from the sealed box, it was not working. The phone keeps on restarting. I phoned Monday, 18 March and been advised by Melody Dhlamini to take it to nearest Cell C together with the proof of purcharse which she e-mailed to me. She said they will look at it and swop it out for me or they will give me a OBF form (out of the box fault). I went all the way to the nearest Cell C and they refused to help me cause they said it is Bayport's problem and it was not purchased from them! Why can't Bayport just send out someone to pick up the phone and bring me a new one??? It's a brand new phone that is not been working since the moment I took it out of the box!!! No one cares to help me or to give a solution to this problem. So I must now pay 24 months for a phone on contract which is broken from the day I opened the box??? I will not leave this matter here. Surely someone at Bayport must be able to help me??? Why must I drive around and make plenty of phone calls just to get absolute nowhere!!
