Had 2 African bank loans, I got retrenched. The attorney for African Bank being Smith & Smith contacted my husband's HR depth for garnish orders. It was done and the 2 loans were paid in full via garnish order. 1 Acc was overpaid by R10, 000 and we queried it as well as our names still on ITC AND being called to settle the loans. Every year we get calls and letters from new attorneys requesting us to pay the account up, when we explain what had happened and supply all the documetation we just never hear from them until new attorneys contact us. We have gone into African Bank already to resolve this mailed them, sent the documentation to them as well as the attorneys. It is almost 10 years later and nothing has been done. The only answer we ever received was that Smith & Smith did not allocate the garnish paid against the loan accounts outstanding. We are still listed on ITC, we can't buy a house or car or anything. We have R10, 000 owing to us because of an over payment which probably will not be paid to us. I am at my wits end now as the new attorney DMC has called and sent a letter I supplied the information and documentation required and still nothing. Can I sue African Bank?
