I have a loan dating back to 2007. For the last 3 years I have battled to make payments and in the last year and a half I have stopped payments as I do not have funds. I had spoken to the banks Ombudsman, Roshika Pillay, and also her supervisor. As of February 2012 I have had no contact from African Bank regarding the account and any and all attempts to contact Roshika, or anyone in her department, lands on deaf ears. I am now being harassed by VDM Attorneys who are threatening to Garnish my salary for the amount and lodge a judgement against my name.
I have not received any calls, Registered Letters or communication informing me that the account will be handed over. As per the credit act and Prescription act, this is illegal and not allowed. Please assist me with regards to this matter as I cannot afford an attorney to assist.
As per the Prescription act, any loan/debt older than 3 years without any payment or communication must be written off and noted on ITC. This loan is about 6 years old and I have been ignored for a year and a half. No one contacts me from the bank and when I contact them, I get shoved around and no one knows what is going on.
