Worst mistake ever!!

I saw a gumtree ad of Bayport offering a samsung galaxy S3 on contract. I'm a student so i applied for it but with my parents' consent using my mom's details. i specifically asked for the GALAXY S3 and i was told they have it in stock. Everything went smooth and the phone was supposed to be delivered to me in Cape Town but instead it was sent to my Home address in East London. My mom accepted the parcel and i told her to open it and check if all contents were there, after opening it i was shocked when she told me it was written "samsung galaxy s3 mini" instead of the normal galaxy s3.By this time she had already opened the plastic wrapping. She called Bayport and was sent from pillar to post and this went on for days. After a week or so, she was told she can not return it as the parcel was opened. BUT WHO"S FAULT WAS IT TO SEND WHAT WE DID NOT ORDER? Up until today we are stuck with an unused phone that they refuse to take back and cancel the contract/exchange the phone. As far as i know a consumer has up to one month to cancel a cellphone contract with any network but Bayport refuses to cancel or exchange the phone.
