Refusal to pay the Insurance Claim by Dial Direct

We have an Insurance Policy with Dial Direct. Our Vehicle was involved in an accident, we lodged a Claim with Dial Direct. Dial Direct told us due to a Clause in the General Terms and Conditions of the Policy, they are rejecting the Claim. We never received the General Terms and Conditions and we told them that it is their responsibility to provide us with all the information for the Policy. They however refused and rejected our claim and they reffered us to the Ombudsman for Short Term Insurance who obviously supported them.

Related to the outcome of this Claim - Ombudsman for Short Term Insurance (OSTI): The OSTI represents the interests of the Insurance Industry. The Government cannot allow the OSTI to be an Arbitter in insurance disputes because "THERE IS NO WAY THAT HE WILL BE INDEPENDENT" as shown by this case and many others previous. We need the Govermnet Power here, not the OSTI to arbitrate because he will always act in the interest of the Industry.
