Flouting the Consumer Protection Act

Well within six months after I took out a fifth (yes, fifth) contract with Vodacom, the handset packed up. On 14th April 2013 the handset was delivered to Vodacom Repairs in Somerset West. On or about 25 April 2013 I was advised that the telephone was ready for collection. I duly went to the shop on or about 27th April only to be told that the handset was beyond repair and they have a refurbished handset as a replacement. I told the attendant that in terms of the CPA I am entitled to a new phone and she must note that on their system. I duly refused the refurbished handset. On or about 30 April 2013 Vodacom Somerset West phoned to say Head Office agreed to give me a new phone. Without going into any of the unpleasant experiences with Vodacom Somerset West since then, suffice to say, the handset was not new and not sealed in a box. According to the CPA I am entitled to a replacement that is new. I am happy to give the accessories of the faulty phone, together with the original box, back to Vodacom but insist that they comply with the CPA and give me a brand new replacement, sealed and in a box. Finally, and for the record, I did not authorise a "repair".
