My complaint in this matter is against my current cell phone service provider, Cell-C.
I have three individual cell phone contracts registered with them at present, and have been loyal customers for approximately 8 years, never missing one payment and always renewing my contracts.
The issue that I am having currently, though, is with a faulty Blackberry 9360 device, which were booked in for repairs / replacement at the Cell-C PE Regional Office on 5 April 2013. The contract for the specific phone is still active and paid fully up to date.
After they've had the phone for about 20 days, I was informed by them that the handset's warranty expired on 29 March 2013 (i.e. seven days [5 working days]) prior to booking-in the phone for repairs / replacement.
They have, and are still currently, refused/refusing to repair / replace the phone at their costs, even though the Consumers Protection Act No. 68 of 2008 prohibits businesses from rejecting liability for defects where a warranty has only recently expired. They also still have the phone in their possession.
I will certainly not be renewing any one of my contracts with them when they come up for renewal.
