Received new upgrade nokia 701. faulty since new

My uncle have contract with mtn for last 8 years. and never has anyone told him that he can take upgrade mobile every two years. but his contract payments always go up every second year. This time he asked me how it works as he always buy a phone to put his contract sim card in. I went with him to sort his contract out as they also dont tell him the options when he has to re-sign for ANOTHER TWO YEAR CONTRACT to carry on. He received upgrade mobile, and said i can use it. Since beginning this nokia 701 has never worked as it does not charge. I took it in on uncles instructions. I pointed out to them to check charger and the mobile as well. This was in December 2012. Mobile was received frm repairs on January 15th 2013. I took it back very next day with the same problem. 16th January 2013. In February they said they notified to say mobile is back from repairs. As i popped in by myself to ask when to get mobile. They tried to to trick us by saying it was the battery when they added a new battery themselves the first time. Mobile went straight back for repairs..4th time it went back and then i received it with same problem. on 28/03/2013..i called Bronwyn same day to tell her.
