BAD SERVICE AND UNAUTHORISED PRACTICES

Dear Hello Peter,

In 2007 I upgraded my phone to a Nokia E52 via the Call Centre. They delivered my phone, but within a week I reported the phone faulty and they arranged with Oram to collect the faulty phone for repairs. After numerous calls and going as high as I could in the call Centre, I paid for a contract for a phone I never received.

Towards middle 2012, I was a bit behind on my payments as I did not have a Job and managed to pay the full outstanding balance of my Contract which is a Talk 350 (wherein you get about 300 minutes talk time per month) in full in October 2012. They then re-activated my account and I had aprox 1500 available minutes.

On the 1 Nov 2012 they "Permanently de-activated" my account and to date did not re-activate my line. The irony is, they are still trying to debit my account every month for this line that they permanently deactivated.

I would like to know, who is going to replace the phone which I never received, which I paid for on a contract for 2 years, and who is going to refund me all the minutes and the banking fees for all the returned debit orders. Isn't this a breach of contract as they did not deliver the service I signed for?
