21 to 30 days to sort out an out of box failure!

After taking out a new Cell C contract in Jan I received an SMS on 13 Feb that my order will be delivered "shortly". It was only delivered on 21 Feb (more than a week later).
I charged the handset (an iPhone 5) and noticed that it loses battery power very quickly - about twice as fast as my iPhone 3Gs which is more than 2 years old and very well used).
I read up about it on the net and followed all the tips to save battery life like switching off Bluetooth and push notifications but it made no difference. The battery would drain at about 10% in half an hour even on standby.
I took the handset to a Cell C shop and got told I have to Phone Cell C direct who promptly referred me back to the nearest Cell C shop and told me that it would take 21 to 30 days for Cell C to decide whether it was actually an out of box failure and they they would decide whether to replace the battery or give me a new handset.
Surely it can't take three weeks to a month to assess this and surely they should just give me a new handset and return the faulty one to their supplier? In the mean time I have to pay subscription without service.
My Cell C experience has been really bad and I regret moving to them.
