Damaged Samsung Galaxy S3 (On Receipt)

I upgraded my mobile to a Samsung Galaxy S3 & when I got home I removed the protective film on the screen & noticed that there was a crack on the top left of the screen. Obviously I hadn't dropped it.
I immediately returned to MTN Gateway to return it & the consultant checked the phone & agreed that there were no marks indicating that the phone had been dropped. He then said that I must leave the phone there & they will follow-up.
I received a call this morning (Monday, 18 February) stating that they will not replace the phone as it had been damaged.
