Paying upgrade for cancelled contract

I upgraded one of my contracts, due to poor delivery I had to cancel, confirmed twice with cancellation department it was done; now I get a bill for the full upgrade with no unit in my possession and I am told the debit order is still going off with no refund... Is this legal?
