Raising the defence of Prescribed debt

Hello Virgin Mobile,

I refer to our previous correspondence, and wish to raise the defence of prescribe debt. I don't want to be harassed about this matter, because I meet the requirements as laid out in the Prescribe Act 68 of 1969. See below.

Please close this file. Also advise your debt collectors, Real People not to collect on this debt.

What exactly is prescribed debt? According to the Prescription Act 68 of 1969, section 10 (1), a debt is prescribed if:

* You have not acknowledged the debt in the past 3 consecutive years, either in writing or verbally
* You have not made any payment towards the outstanding amount, nor have you promised to pay
* The creditor has not summonsed you for this debt within 3 consecutive years

Thank you.

G.Walke
